Agreement to these terms

Patacca Services LLC ("we" or "us") provides this website, pataccaservices.com (the "site"), subject to these Terms of Use. When you send the inquiry form, you agree to these Terms of Use, as the notice above the form's Send button says. By otherwise using the site, you also agree to them. If you do not agree, please do not use the site.

In these Terms of Use, our "Affiliates" means our operating companies, AnchorPoint Education Group and K12 Professional Development Tracker, and our and their owners, officers, employees and agents.

Changes to these terms

We may update these Terms of Use. When we do, we will post the new version on this page with a new effective date. Changes apply only from that date, and any dispute about something that happened before a change is governed by the version in effect at that time.

About this site

This is the corporate website of Patacca Services LLC, the parent company of AnchorPoint Education Group and K12 Professional Development Tracker. It describes those operating companies and links to their websites. Nothing is sold on this site, and it has no user accounts or logins. It collects the information you choose to send through the corporate inquiry form and, if you accept analytics cookies, information about how you use the site, as described in our Privacy policy, which is part of these Terms of Use.

We may change or discontinue the site, or any part of it, at any time.

Operating companies and client agreements

AnchorPoint Education Group (anchorpointeducationgroup.com) and K12 Professional Development Tracker (k12pdtracker.com) operate their own websites. Each of those sites has its own terms and privacy policy, which govern your use of them and of the products and services they offer.

These Terms of Use cover only your use of this website. If you are a client, the services you receive are governed by your written agreement with us or with one of our operating companies. If that agreement conflicts with these Terms of Use, the agreement controls. Clients are billed through our Zoho Books client portal (books.zoho.com/portal/pataccaservicesllc), which is governed by the client's agreement and by Zoho's terms.

Acceptable use

You must use the site lawfully, and you are responsible for anything you send through it. You agree not to send, through the inquiry form or otherwise, any content that:

  • is unlawful, threatening, abusive, harassing, defamatory, deceptive, fraudulent, invasive of another's privacy, or sexually explicit;
  • victimizes, harasses, degrades or intimidates an individual or group on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability;
  • infringes any patent, trademark, trade secret, copyright, right of publicity or other proprietary right of any party;
  • is unsolicited advertising, bulk email ("spam"), a chain letter, or any other unauthorized solicitation;
  • contains viruses or other code designed to disrupt, damage or gain unauthorized access to any software, hardware, network or data; or
  • impersonates any person or entity, including any of our employees or representatives.

You may not attempt to breach the security of the site or of any network or server connected to it, use automated means to send the inquiry form, or interfere with anyone else's use of the site. We may report suspected illegal activity to law enforcement and cooperate with its investigations.

Links to other sites

This site links to other websites, including those of our operating companies. We are not responsible for the content or practices of websites we do not control, and a link to a site we do not control does not mean we endorse it.

Our content and trademarks

The text, graphics, logos, photographs and other material on this site ("content") belong to Patacca Services LLC or its Affiliates, or are used with permission, and are protected by copyright and other laws. You may view, print and share pages of this site for your own reference or your organization's internal use, provided you keep any copyright and other notices. Any other copying, modification, republication or distribution requires our prior written permission.

The names, logos and marks of Patacca Services LLC, AnchorPoint Education Group and K12 Professional Development Tracker are trademarks or service marks of Patacca Services LLC or its Affiliates. Other names and marks belong to their respective owners. Nothing in these Terms of Use gives you any right to use our names, logos or marks.

What you send us

Personal information you send through the site is handled as described in our Privacy policy. Please do not send us confidential or proprietary information through the site; we cannot treat anything sent through the inquiry form as confidential unless we have agreed to in writing.

If you send us suggestions, ideas or feedback about our companies or services, you agree that we may use them without any obligation to you.

Intellectual property concerns

We respect the intellectual property of others. If you believe something on this site infringes your copyright, trademark or other rights, please write to us at [email protected] or at the mailing address below. Identify the work or right, the material on this site you are concerned about, and how we can reach you. We will review every notice and respond.

The site is general information about our companies. It is not professional advice, and it does not create a client relationship or any obligation on our part.

Limitation of liability

To the extent permitted by law, you agree to defend, indemnify and hold us and our Affiliates harmless from claims, liabilities and expenses, including reasonable attorneys' fees, that arise from your breach of these Terms of Use or your misuse of the site.

Suspension of access

We may suspend or block access to all or part of the site, without notice, if we reasonably believe it is being used in breach of these Terms of Use or to harm the site or others.

Governing law and time limit for claims

These Terms of Use and any dispute about your use of the site are governed by the laws of the State of Ohio, without regard to its conflict of laws rules. Any such dispute will be resolved in the state or federal courts located in Ohio, and you and we consent to their jurisdiction. To the extent permitted by law, any claim about your use of the site must be brought within one year after it arises.

The site is operated from the United States and is intended for use in the United States. If you use it from elsewhere, you are responsible for following your local laws.

General

These Terms of Use and our Privacy policy are the entire agreement between you and us about your use of this site; a written client agreement still governs the services it covers. If any part of these Terms of Use is held unenforceable, that part will be enforced to the extent possible and the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms of Use; we may transfer ours, for example as part of a reorganization or sale of our business. We are not responsible for delays or failures caused by events beyond our reasonable control.
